HIPAA Notice of Privacy Practices

This Notice describes how medical information about you may be used and disclosed and how you can get access to this information. Please review it carefully.
Our Duty to Safeguard Your Protected Health Information
We are required by law to maintain the privacy of your protected health information (PHI), to provide you with this Notice of our legal duties and privacy practices, and to follow the terms of this Notice. We may change the terms of this Notice at any time. Any changes will apply to PHI we already have about you as well as any PHI we receive in the future.
How We May Use and Disclose Your PHI
For Treatment: We may use and disclose PHI to provide, coordinate, or manage your psychotherapy and related health care services.
For Payment: This practice is cash-pay only. We do not bill insurance companies. If you request a superbill for PPO reimbursement, that document is provided to you and you manage submission to your insurer.
For Health Care Operations: We may use PHI for administrative, quality assurance, and legal purposes necessary to operate the practice.
As Required by Law: We will disclose PHI when required to do so by federal, state, or local law, including mandatory reporting requirements.
Exceptions — When Disclosure May Occur Without Your Authorization: In limited circumstances, we may disclose PHI without your written authorization: (1) to avert a serious and imminent threat to your health or safety or the health or safety of another person; (2) as required by court order or subpoena; (3) to report child abuse, elder abuse, or dependent adult abuse as required by Texas law; (4) for oversight activities authorized by law.
Your Rights Regarding Your PHI
Right to Inspect and Copy: You have the right to inspect and receive a copy of PHI maintained in your clinical record.
Right to Request Amendments: You have the right to request that we amend PHI you believe is incorrect or incomplete.
Right to an Accounting of Disclosures: You have the right to request an accounting of disclosures of your PHI made outside of treatment, payment, and health care operations.
Right to Request Restrictions: You have the right to request restrictions on certain uses and disclosures of your PHI.
Right to a Copy of This Notice: You have the right to receive a paper copy of this Notice upon request.
Complaints
If you believe your privacy rights have been violated, you may file a complaint with Kyden Counseling or with the U.S. Department of Health and Human Services Office for Civil Rights. We will not retaliate against you for filing a complaint.
